THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 41836 of 2015 ORDER:

The vehicle of the petitioner bearing registration No. MH-39-1810 was seized under Vehicle Check Report dated 18.12.2015 on the ground that it was allegedly plying on hire basis by collecting amounts from the passengers.

It is the case of the petitioner that the passengers in the vehicle were none other than his family members and that they were on a religious trip to Pedda Gutta (Bada Pahad).

Learned Assistant Government Pleader for Transport states that the petitioner would be at liberty to approach the authority concerned for release of his vehicle on suitable terms. In that view of the matter, this Court sees no purpose served in keeping this matter pending and inviting a counter affidavit from the respondent authorities.

The Writ Petition is accordingly disposed of permitting the petitioner to make a written representation to the Secretary, Regional Transport Authority, Nizamabad, the second respondent, seeking release of his vehicle stating his case. Thereupon, the second respondent shall consider the said representation in accordance with law and take appropriate action as deemed fit and proper. In the event the second respondent directs release of the vehicle to the petitioner, it shall be open to him to impose such conditions as may be found appropriate as per norms. This exercise shall be completed expeditiously and in any event not later than two weeks from the date of submission of the representation by the petitioner. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. _____________________ SANJAY KUMAR, J Date: 23.12.2015
