THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2133 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/ accused 2 in Crime No.63 of 2015 on the file of Amberpet Police Station, Hyderabad, registered for the offences punishable under Sections 3 and 4 of A.P. Gaming Act, wherein the petitioner arrayed as accused.

Heard the learned counsel for the petitioner and the learned Pubic Prosecutor.

It is alleged in the complaint that a complaint was received from the Sub-Inspector of Police, Commissioner's Task Force, East Zone Team, Hyderabad City, stating that on 01-03-2015, a cricket betting is going on in connection with ICC World Cup 2015 in the residence of one Raja Mahendra Reddy at Ambetpet, Hyderabad and on receiving such complaint, the police went to the house of the said Raja Mahendra Reddy and found that there is some cricket betting between the said person and the petitioner/A2 and thereby seized the cricket betting material, viz., cell phone, T.V., cash and other material.

From a reading of the material on record, it shows that the allegations made in the complaint prima facie constitute the offences, much less the alleged offences. Since the crime is under investigation, this Court is not inclined to interfere with the investigation. Even if the allegations made in the complaint are taken as true, prima facie, a case is made out against the petitioner/A-2. The truth or otherwise of the allegations made in

the complaint will come to light during the course of investigation, and hence, the criminal petition fails and is liable to be dismissed. Accordingly, the Criminal Petition is dismissed. As a sequel thereto, miscellaneous petitions, if any, pending, shall stand closed.
