THE HON'BLE SRI JUSTICE T.AMARNATH GOUD CRIMINAL PETITION NO.8142 OF 2011 ORDER:
This Criminal Petition is filed under Section 482 of the Criminal Procedure Code to quash the proceedings in C.C.No.132 of 2011 on the file of the III Additional Chief Metropolitan Magistrate, Gajuwaka, Visakhapatnam.
Petitioners are A4 and A5 and second respondent is the de facto complainant. Based on the complaint made by the second respondent herein, F.I.R.No.505 of 2010 has been registered by the police, Gajuwaka Police Station, Visakhapatnam under Sections 420, 468, 120-B and 506 IPC. Investigation has been completed and charge sheet has been filed.
Since the issue involved in the present Criminal Petition pertains to a land dispute and is civil in nature, it is not for this Court to deal with the matter under Section 482 Cr.P.C. Accordingly, the Criminal Petition is dismissed. However, the petitioners-A4 and A5 shall not be arrested pending the proceedings and they shall make themselves available before the concerned police station as well as before the Court concerned as and when their presence is required.
