HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36423 of 2018 ORDER:

1) Heard.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.3 in not receiving the document for registration in respect of the land admeasuring 400 square yards in Survey No.17/A, situated at Pigilipur village, Hayathnagar mandal, Ranga Reddy District, as illegal and arbitrary.

3) The averments in the affidavit filed in support of the writ petition would show that one Sri T.Yadaiah, was the owner of the land admeasuring Ac.0.36 1⁄2 guntas in Survey Nos.199, 200, 206, Bacharam village, Hayathnagar mandal, Ranga Reddy District. The said land was affected in the Outer Ring Road Project and as such the Government vide G.O.Ms.No.14, allotted the land admeasuring 220 square yards in Survey No.17/A, situated at Pigilipur village, Hayathnagar mandal, Ranga Reddy District. By virtue of the said allotment, one Yadaiah claims to have become owner of the said plot and thereafter executed a sale deed in favour of the petitioner for valid consideration. In order to get the document registered, the petitioner is said to have approached respondent No.3 requesting to provide details of

registration charges, but the same is not being done. Challenging the same, the present writ petition is filed. 4) Learned Government Pleader for revenue would submit that the Sub-Registrar may be directed to deal with the request of the petitioner, in accordance with the provisions of the Registration Act.

5) Having regard to the above, the writ petition is disposed of directing the petitioner to present the document for registration. If the document presented by the petitioner is in accordance with the provisions of the Indian Stamps and Registration Act, and if the land of the petitioner is not under the prohibitory list, the authorities shall deal with the same, in accordance with law. If the authorities are not intending to register the document, the authorities shall assign reasons for rejecting the registration and communicate the same to the petitioner, at the earliest.
