THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Writ Petition no.36444 of 2018 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking verbatim the following relief: " ...to issue an appropriate writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction of the Respondents in releasing the due payment of Rs.39,15,362/- for completion of the contract work Krishna Pushkarams vide Contract Agreement Roc No.493/2016-G5 dated 26-7-2016 is illegal, arbitrary, mala fide, unreasonable and consequently direct the respondents to pay the due amount of Rs.39,15,362/- with interest @ 24% from the date of submitting the bill dated 14-10-2016 and pass such other order or orders may deem fit and proper in the circumstances of the case."

I have heard the submissions of Sri D.Subbaramaiah, learned counsel appearing for the petitioner; and, of the learned Government Pleader for Panchayat Raj & Rural Development appearing for the respondents 1 to 5. I have perused the material record. 3.

The only grievance of the writ petitioner, as could be seen from the allegations and the averments in the affidavit filed in support of the writ petition, is non payment of Rs.39,15,362/ - despite completion of the contract works related to Krishna Pushkarams. 4.

Learned Government Pleader, while placing on record the copy of letter of the Director, Panchayat Raj & Rural Development, addressed to the Principal Secretary to Government, and also the letter, dated 04.06.2018, submits that the matter relating to payment of amount due to the petitioner is receiving the attention of the Government, and that the Government is likely to give revalidation orders in view of the lapse

MSRM, J W.P.No.36444 of 2018 of funds; and, that as and when the revalidation orders are issued by the Government, the amount due to the petitioner would be paid as expeditiously as possible.

Recording the submissions, the writ petition is disposed of directing the respondents to pay the amount due to the petitioner, as expeditiously as possible, and preferably, within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
