THE HONOURABLE SRI JUSTICE RAJA ELANGO Crl.P.M.P.No.2099 OF 2016 & CRIMINAL PETITION No.1963 OF 2014 ORDER:
1. The above Criminal Petition is filed by the petitioners (respondents 1 to 6 in DVC) seeking to quash the proceedings in DVC No.1 of 2014 on the file of the Judicial Magistrate of First Class, Special Mobile Court, Guntur.
2. When this matter has been taken up, the petitioners and the 2nd respondent in the Criminal Petition appeared before this Court and submitted through their Counsel that due to intervention of elders, they entered into compromise and therefore, the proceedings in the above DVC may be quashed. The 2nd respondent filed an affidavit to that effect. Both the parties filed a joint memo of compromise.
3. In view of the compromise arrived at between the parties, the continuation of the proceedings against the petitioners in the above DVC would be the exercise in futility. Therefore, this Court feels that it is just and proper to quash the proceedings against the petitioners herein in the above DVC. Hence, the above Crl.P.M.P is ordered, and the proceedings against the petitioners in DVC No.1 of 2014 on the file of the Judicial Magistrate of First Class, Special Mobile Court, Guntur are quashed. The petitioners and the 2nd respondent are directed to pay a sum of Rs.5,000/- (Rupees Five Thousand only) together towards costs on or before 15.3.2016 to the Andhra Pradesh State Legal Services Authority. The Registry is directed to issue a copy of this order to the parties concerned after furnishing the receipt of payment of costs.
4. Accordingly, the above Crl.P.M.P is ordered and the Criminal Petition is allowed. Consequently, miscellaneous petitions pending, if
any, shall stand closed.
