HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.5703 of 2016 ORDER:

The plaintiff of O.S.No.3 of 2009 in the suit for bare injunction pending disposal and during trial filed I.A.No.91 of 2016 for appointment of Advocate Commissioner to note down the physical features of the plaint schedule property, the lower Court dismissed the application stating no merits.

A perusal of the impugned order of the lower Court no way requires interference, but for to say after completion of evidence of both the parties from what are the existing physical features on land as on date if at all in dispute to decide by virtue of this order either on the application of any of the parties or even suo motu, the Court can appoint an Advocate Commissioner.

Accordingly and in the result, the revision petition is disposed of.

Consequently, miscellaneous petitions, if any shall stand closed. No costs.
