This Civil Revision Petition (CRP) is filed against issue of notice by the XI Additional District Judge, Visakahpatnam (for short 'the lower Court') in IA.No.167 of 2016 filed by the petitioners for interim injunction pending the suit viz., OS.No.85 of 2016. At the hearing, the learned Counsel for the petitioners submitted that though the IA was filed in the year 2016, the lower Court has not been disposing of the same. In my opinion, this revision is wholly misplaced as, if this Court sets aside the order of the lower Court ordering notice, the same will not enure to the benefit of the petitioners. On the contrary, the whole proceedings will come to a standstill. As the grievance of the petitioners mainly related to nondisposal of IA.No.167 of 2016, the lower Court is directed to dispose of the same within three months from the date of receipt of this order. If any of the respondents are unserved, the petitioners are entitled to file an application for service of notices through substituted service. Subject to the above observations and direction, the CRP is disposed of.
