THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12623 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, petitioner herein prays that this Hon'ble Court may be pleased to issue writ, order, direction more particularly one in the nature of Writ of Mandamus declaring the action of Respondent No. 2 in issuing Show Cause Notice proceeding No. C4/823/2012 dated 01-032016 as illegal and arbitrary and consequently set-a-side the said proceedings and pass such order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Challenge to the impugned show-cause notice dated 01.03.2016 is not on any jurisdictional aspect or on the ground that it reflects non application of mind.

Reliance sought to be placed by the petitioner upon the proceedings dated 23.07.1996 of the Mandal Revenue Officer, Bejjanki, is misplaced as the said proceedings were not based upon any regular enquiry. It appears that the impugned show-cause notice was issued initiating an enquiry under the Andhra Pradesh (SC, ST & BCs) Regulation of Issue of Community Certificates Act, 1993, for the first time. It is therefore for the petitioner to submit his response thereto and make out his case. No interference is warranted by this Court at this stage.

The writ petition is misconceived and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
