HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.36589 of 2018 ORDER:
1) The present writ petition came to be filed questioning the action of the respondents in not registering the documents presented by the petitioner in respect of land admeasuring Ac.0.07 cents in Sy.No.91-2 (old) 91-3 (new) and Ac.0.17 cents in Sy.No.91-3 (old) 91-4 (new) at Venti Thadi Agraharam Village, Vijayanagaram Mandal and District on the pretext that the said land is in the prohibitory list of properties under Section 22-A of the Registration Act.
2) Learned counsel for the petitioner would submit that without assigning any reasons the authorities are neither receiving the document nor processing the same. 3) The Government Pleader for Revenue (AP) would submit that the reason given in the affidavit would show that the land is in the prohibitory list under Section 22-A of the Registration Act. For that reason only, the authorities have not received the document. But the petitioner should know the reason for not registering the document. Having regard to the above, the petitioner shall present the document for registration, in which event the authorities concerned shall deal with the same, if it is in accordance with the provisions of Indian Stamp
Act and Registration Act. If the property is falling in the Prohibitory List under Section 22-A of the Registration Act, the authorities concerned shall return the same assigning reasons, enabling the petitioner to avail the remedy available under law.
4) With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to disposal of the writ petition, miscellaneous petitions, if any pending shall stand closed.
