THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34940 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the third respondent in not providing police protection to the fourth and fifth respondents for execution of balance work and to extend the power supply in spite of the letter dated 06.10.2016 issued by the fifth respondent in respect of the petitioner house plots, which were purchased by the petitioner through registered sale deeds, as illegal and arbitrary and consequently, to direct the respondents 2 and 3 to provide police protection to the respondents 4 and 5 for execution of balance work and to extend the power supply to the petitioner house plots.

Heard and perused the material.

Learned counsel for the petitioner submits that petitioner is the owner of the house plots mentioned above and for electricity connection tot he said house plots, he approached the respondents 4 and 5 and subsequently, some electric poles were also erected. At this stage, the respondents 6 and 7 are interfering and objecting the work of the respondents 4 and 5 in erecting poles for power supply, alleging that they are the owners of the said house plots. Hence, the petitioner approached the respondents 2 and 3 for providing police protection to the respondents 4 and 5 for providing power supply to the house plots of the petitioner and that the respondents 4 and 5 also lodged a complaint against the respondents 6 and 7. Hence, learned counsel seeks a direction to the respondents 2 and 3 to provide police protection to the respondents 4 and 5 for continuing their work.

Considering the facts and circumstances of the case, the respondents 2 and 3 are directed to consider the contents of the complaint

and if there is any necessity, to provide police protection to the respondents 4 and 5 in providing power supply to the house plots of the petitioner and also act in accordance with law. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 01.11.2016 pln
