HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36586 of 2018 ORDER:

1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in not receiving the sale deed for registration and without assigning any reason as illegal, arbitrary and violation of principles of natural justice.

2) At the time when the matter is taken up for hearing, learned Government Pleader for Revenue (AP), on instructions, states that the property which is subject matter of dispute is a government land mentioned in the prohibitory list under Section 22-A of the Registration Act.

3) At this stage, the learned counsel for the petitioner submits that the Sub-Registrar may be directed to pass a rejection order, in which event he can challenge the same before the appropriate authority.

4) Having regard to the above, the writ petition is disposed of, directing the petitioner to present the document for registration, in which event, the 3rd respondent shall receive and register the document, if the same is in order as per provisions of Indian Stamp Act and Registration Act and the rules made thereunder and if he is not inclined to register the same, he shall record reasons and communicate the same to the parties.

5) There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
