Heard counsel for the petitioner and the Government Pleader for Revenue appearing for respondents 1 and 2.

Petitioner in this Writ Petition challenges the proceedings dt.05.12.2015 in Memo No.20926/Reg.II/2015-I of the 1st respondent staying proceedings pursuant to order dt.09.06.2015 in A.A/C.F.No.157/ 2014 of the 2nd respondent.

3. Though several contentions are raised by counsel for petitioner, but this Court is not inclined to entertain the same in this Writ Petition, since the petitioner is entitled to move an application before the 1st respondent to vacate the stay granted by him.

Therefore, the Writ Petition is disposed of granting liberty to the petitioner to move an application before the 1st respondent to vacate the interim stay granted by the 1st respondent in Memo No.20926/Reg.II/2015-I on 05.12.2015; the 1st respondent is directed to entertain the same, if presented by the petitioner, and consider the same in accordance with law, after issuing notice to respondents 3 to 7, within a period of twelve (12) weeks from the date of presentation of application by the petitioner and communicate his decision thereon to the petitioner. There shall be no order as to costs.

5. Consequently, Miscellaneous Petitions pending if any, shall stand closed.
