This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused, for grant of bail in Crime No.233 of 2018 of Narayanguda Police Station, Hyderabad, registered for the offence punishable under Section 376 of I.P.C.

Heard the learned counsel for the petitioner/ accused and the learned Additional Public Prosecutor representing the respondent-State and perused the record.

The learned counsel for the petitioner/ accused would submit that there was love between the de facto complainant and the petitioner/ accused. No sexual assault is committed. A false report is lodged against him and ultimately, prayed to allow the petition.

The learned Additional Public Prosecutor opposed the grant of bail to the petitioner/ accused.

As per the material placed on record, the petitioner/ accused pressurised the de facto complainant to love him.

She refused his proposal.

On 04.08.2018, the petitioner/ accused called her to his house to talk. When she went there to seek clarification, he forcibly committed sexual intercourse on her. There are specific allegations. The punishment for the alleged offence is severe. It is not a fit case to allow the petition. 6.

In the result, the Criminal Petition is dismissed.

Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed.
