HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.40557 OF 2014 O R D E R:

The petitioners claimed to be the successors in interest of the land in Sy.No.313 of Kondagadapa village of Mothkur Mandal, Nalgonda District, over an extent of Ac.10.28 gts. Petitioners purchased the same through Registered sale deed No.5/2007, dated 1612.01.2007. Thereafter, patta was mutated in the name of petitioner vide amendment 22/2009-10 and pattadar passbook and title deeds were issued in his favour. Later, he came to be aware that the land in question, which has been purchased by him, is Inam land and he was advised to obtain occupancy certificate, thereafter he made an application for issuance of occupancy certificate in Form No.1 under Rule 5(2) of Inams Abolition Rules, 1975 on 25.01.2014, and the same was taken on file of the 3rd respondent and given file No.G/5415/2014. Since then no orders have been passed.

Hence, this writ petition. Heard the learned counsel for the petitioner, as well as the learned Assistant Government Pleader for Revenue (Telangana). The relief that is being sought by the petitioner in the present petition is disposal of his application in accordance with law. Learned Assistant Government Pleader submits that he has no objection for issuance of a direction to the 3rd respondent to consider the application of the petitioner in accordance with law and pass orders thereafter.

Accordingly, the Writ Petition is disposed of with a direction to the respondent No.3 to pass orders on application dated

25.01.2014 of the petitioner for issuance of Occupancy Certificate. Considering the fact that this application was filed in the month of January, 2014, and one year had already been elapsed, the 3rd respondent shall pass appropriate orders within a period of 8 weeks from the date of receipt of this order. Accordingly, the Writ Petition is closed. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
