Heard Sri V. Narasimha Goud, learned counsel appearing for the petitioner and Sri B. Mayur Reddy, learned standing counsel for the respondent-Corporation.

2. The petitioner was appointed as conductor in the year 1990 in the respondent-Corporation and his services were regularised with effect from 01.01.1992. Subsequently he was removed from service vide proceedings of the 4th respondent dated 21.03.1997 on the ground that he was absent for duties from 15.03.1995 to 22.03.1995. The petitioner preferred an appeal to the 3rd respondent and in the appeal, the 3rd respondent passed order setting aside the order of removal but directed reinstatement into serviced as a fresh conductor vide orders dated 08.09.1997. In pursuance of the said order, he joined in the 5th respondent Depot as a fresh Conductor. The petitioner preferred a revision dated 11.11.1997 to the 2nd respondent for grant of consequential benefits, which is pending since then.

3. Learned counsel appearing for the petitioner submits that the punishment is grossly disproportionate and ought not to have been imposed against the petitioner. He further submits that the order passed by the Appellate Authority-3rd respondent appointing the petitioner as a fresh conductor is also not proportionate to the gravity of the misconduct alleged.

4. In any event, since the revision filed by the petitioner is pending before the 2nd respondent, the writ petition is disposed of, without going into the merits of the case, directing the 2nd respondent

to dispose of the revision dated 11.11.1997 submitted by the petitioner, within a period of four weeks from the date of receipt of a copy of this order, if it had not already been disposed of and the revisional authority is directed to communicate the order to the petitioner forthwith, if it is disposed of already.
