This transfer petition is filed to withdraw FCOP No.788 of 2015 on the file of the Judge, Family Court, L.B.Nagar, Ranga Reddy District and transfer the same to the Court of Principal Senior Civil Judge, Mancherial, Adilabad District.

It is the case of the petitioner that her marriage with the respondent was performed on 13.05.2007 at Mancherial, Adilabad District and out of their wedlock, a female child Karkuri Deksha Manvitha was born. As the respondent is harassing the petitioner, she filed DVC No.06 of 2015 on the file of the Principal Judicial Magistrate of First Class at Mancherial and same is posted for appearance of the respondent. The petitioner is unable to attend the Court at L.B.Nagar, Ranga Reddy District and defend herself in O.P.No.788 of 2015 as the same is at a distance of 250 kms away from Mancherial. There is no male assistant except her father and that she cannot travel along with her daughter for attending the Court at L.B.Nagar. Hence, sought for transfer of FCOP No.788 of 2015 on the file of the Judge, Family Court, L.B.Nagar to the Court of Principal Senior Civil Judge, Mancherial, Adilabad District.

Though notice is ordered and served on the respondent, no counter affidavit is filed by the respondent. Heard learned counsel for the petitioner.

The averments made in the affidavit are not rebutted and there is no opposition from the respondent. Moreover DVC No.6 of 2015 filed by the petitioner is pending on the file of the Principal Judicial Magistrate of First Class at Mancherial and the respondent has to attend the same. Since there is no male assistant to the petitioner, it is difficult for her to travel all the way from Mancherial to L.B.Nagar

along with her daughter for attending the Court. In view of above facts and circumstances referred to above, I am of the opinion that FCOP No.788 of 2015 District, on the file of the Judge, Family Court, L.B.Nagar, Ranga Reddy District is liable to be transferred to the Court of Principal Senior Civil Judge, Mancherial, Adilabad District. Accordingly, the Tr.CMP is allowed. No costs.
