The criminal petition is filed for quash of the proceedings in Cr.No.821 of 2010 on the file of the Station House Officer, Saifabad Police Station, Hyderabad. The offence alleged is under Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1890.

Heard the counsel for the petitioner and the learned Public Prosecutor appearing for the first respondent. None appears for the second respondent.

A perusal of the compliant would show that the petitioner has abused the complainant in his caste name and the specific abuses are also mentioned in the complaint. Hence, in the light of the said allegations, the contention of the counsel for the petitioner that since rent is not paid by the complainant, he filed this false complaint in order to avoid the said payment; cannot be taken into consideration. It is a matter, which has to be adjudicated at the time of trial. Hence, at this stage, it is not advisable to quash the proceedings. The criminal petition is dismissed. Interim stay, granted earlier in CRPMP.No.4759 of 2011 dated 17.06.2011, stands vacated. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
