HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36607 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of at the admission stage.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.5 in not issuing new pattadar pass books in pursuance of the Samagra Survey of lands by replacing the old pattadar passbooks and also not issuing the Raithu Bandu cheque to the petitioner for each acre Rs.4,000/- in respect of petitioner's land in Survey No. 40/ 7, admeasuring Ac. 0.07 cents, Survey No. 55/3 admeasuring Acs. 3.75 cents and Survey No. 97/8 admeasuring Ac. 0.20 cents, Survey No. 12/1 admeasuring Acs.2.90 cents and Survey No. 77/8 admeasuring Ac. 0.80 cents situated at Edjerlapally Village of Vajedu Mandal, JayashankarBhupalapally District and also Acs.3.26 cents in Survey No. 11/2, situated at Mutharam Village of Vajedu Mandal Jayashankar Bhupalapally District and also Survey No. 61/4 admeasuring Acs. 6.00 cents situated at Bomanapally Village of Vajedu Mandal, JayashankarBhupalapally District in all total Acs.16.29 cents, situated at Edjerlapally Village of Vajedu

Mandal, JayashankarBhupalapally District, as illegal arbitrary.

3) Though various grounds are raised, learned counsel for the petitioner would submit that though the petitioner got issued a legal notice dated 02.06.2018 to respondent No.5 seeking issuance of new pattadar pass books and Raithubandhu cheque in respect of the lands referred to above, till date, no orders are passed.

4) Learned Government Pleader for revenue would submit that if petitioner is otherwise entitled to, the authorities may be directed to deal with the same, in accordance with law. 5) Recording the said submissions, the writ petition is disposed of directing the Tahsildar - respondent No.5 before whom the application dated 02.06.2018 is made, seeking issuance of new pattadar pass books and Raithubandhu cheque in respect of the lands referred to above, shall examined the same, in accordance with law, as early as possible, preferably within a period of four to five months from the date of receipt of a copy of the order, after hearing all the concerned.
