HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 45258 of 2016 Order:

This Writ Petition is filed challenging the action of the respondents 2 and 3 in not initiating steps for removal of unauthorizedly constructed flats viz., 601 and 602 on the 5th floor of L.B. Towers, bearing Door No.15-3-61 at Ward No.2, Block-4, T.S.No.126-122, Century Club Road, Maharanipet, Visakhapatnam.

When the matter is taken up for consideration, learned Standing Counsel appearing for the second respondent produced before this Court a copy of regularization issued in respect of Flat Nos.601 and 602 on the 5th floor of the said building on 02.09.2016. In view of the same, learned counsel for the petitioners seeks permission of this Court to withdraw the Writ Petition with liberty to take appropriate legal proceedings in accordance with law.

Permission is accorded and, accordingly, the Writ Petition is dismissed as withdrawn. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
