HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.16511 OF 2016 ORDER:
Heard the learned counsel for the petitioner, learned Government Pleader for Irrigation for respondents 1 to 3 and learned Government Pleader for Revenue for respondent No.4. This writ petition is filed seeking the following relief :- "...............Writ of Mandamus declaring the action of the respondents in seeking to dispossess the petitioner from the land in Sy.No.210 admeasuring Ac.14-00 situated at Ramanjapur Village of Shamshabad Mandal of Ranga Reddy District without following due procedure under law as illegal, arbitrary and violative of Art.14, 21 and 300-A of Constitution of India and consequently direct the respondents not to dispossess the petitioner from the land in Sy.No.210 admeasuring Ac.14-00 situated at Ramanjapur Village of Shamshabad Mandal of Ranga Reddy District without following due process of law and pass such other............."
It has been contended by the petitioner that she is the owner of the land admeasuring Ac.14-00 in Sy.No.210 of Ramanjapur Village, Shamshabad Mandal, Ranga Reddy District and that the respondents are trying to interfere with her possession without following due process of law. Therefore, learned counsel for the petitioner contends that appropriate orders be passed in the writ petition directing the respondents not to dispossess the petitioner from the subject land without following due process of law.
Learned Government Pleader appearing for respondents contends that respondents are not taking any steps to dispossess
the petitioner and if the respondents intend to acquire the land of the petitioner, they would follow due process of law while doing so. This Court, having considered the rival submissions of the learned counsel appearing for the respective parties is of the considered view that this writ petition can be disposed of directing the respondents not to dispossess the petitioner from the subject land without following due process of law. However, it is always open for the respondents to take appropriate action against the petitioner if the petitioner is found to be in unlawful possession. With the above direction, this writ petition is disposed of. No order as to costs.
