THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3532 of 2015 ORDER:
Memo dated 23.01.2015 issued by the 1st respondent-Principal Secretary to the Government, is challenged before this Court on the ground that the 1st respondent has no jurisdiction to entertain any petition against the orders passed by the 2nd respondent-Joint Collector, under the A.P. (T.A) Tenancy and Agricultural Lands Act, 1950.
2. At the hearing, Sri M. Muralidhar Reddy, advocate representing the 5th respondent-Caveator, submits that the 5th respondent has mistakenly approached the 1st respondent seeking stay of the orders of Joint Collector; and having come to know that against the orders of the Joint Collector, a Revision Petition under Section 91 of the Act lies before this Court, he filed a revision petition before this Court and the same is numbered as Civil Revision Petition No.27374 of 2014. Hence, the learned counsel submits that the writ petition may be allowed and the impugned memo may be set aside.
3. Accordingly, at the instance of the 5th respondent, without going into the merits of the case, the writ petition is allowed quashing the Memo dated 23.01.2015, as having been issued without authority of law. No order as to costs.
Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
