THE HON'BLE SRI JUSTICE S.V.BHATT W.P.No.334 of 2012 ORDER:

The petitioner prays for the following relief :- ".... to issue a Writ order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 1st respondent Corporation in empanelling the 3rd respondent as 1st candidate for awarding dealership of the retail outlet at Pasigedda Mill Junction to Sri Kurmam Junction, Srikakulam District as illegal, arbitrary and unjust and consequently direct respondents 1 and 2 to set aside the same and reconsider their decision by duly observing the guidelines in vogue and award the said dealership to the petitioner forthwith ...." At request of learned Standing counsel, the writ petition was adjourned from 04-08-2016 to today.

The Standing counsel places on record the information received from 1st respondent. According to the information, there is no progress in allotment of dealership of retail outlet at Pasigedda Mill Junction to Sri Kurmam Junction, Srikakulam District and the file is under internal scrutiny.

S r i N.Siva Reddy, keeping in view present stage of consideration by the Corporation, submits that the petitioner may be given liberty to assail the entrustment if any made to 3rd respondent, without taking note of objections raised in this behalf by the Corporation.

The statement is placed on record.

The writ petition is disposed of and leave to petitioner to assail if a decision is finally taken to allot the subject outlet to 3rd
