ORDER

This writ petition is filed seeking the following relief: " to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of the respondents herein in not paying the service/terminal benefits to the petitioner is bad, arbitrary, illegal and consequently direct the respondents to settle and pay all the service/terminal benefits of the petitioner to him forthwith and pass such other order or orders which this Court deems fit and proper."

Heard Sri P.Venkateshwer Rao, learned counsel appearing for the petitioner and Sri N.Vasudeva Reddy, learned Standing Counsel appearing for the respondentCorporation. It is the case of the petitioner that he was appointed as a casual Driver in the year 1989 in the respondent-Corporation and his services were also regularized with effect from 1.5.1990. He worked upto August, 2013. Thereafter, he could not discharge his duties owing to his ill health. Subsequently, he got issued a legal notice on 24.07.2018 to the respondentCorporation to settle his terminal benefits. But, no action has been taken by the respondent-Corporation so far. Learned counsel appearing for the petitioner submits that appropriate orders be passed directing the respondent-

Corporation to settle the terminal benefits of the petitioner to which he is entitled to.

Learned Standing Counsel appearing for the respondent-Corporation contends that the case of the petitioner would be considered and terminal benefits would be paid, in accordance with law.

Having considered the rival submissions made by the learned counsel on either side, this Court is of the view that ends of justice would be met if a direction is given to the respondent-Corporation to settle the terminal benefits of the petitioner.

Accordingly, the Writ Petition is disposed of directing the respondent-Corporation to settle and pay the terminal benefits of the petitioner for the service rendered by him, if not already paid, within a period of eight weeks from the date of receipt of a copy of this order. No costs. Miscellaneous petitions, if any, pending shall stand closed.
