This Writ Petition is filed for a Mandamus to set aside the communication, dated 29-10-2015, of respondent No.3 whereunder the petitioner has been removed as the Sector Leader of Anganwadi workers.
At the hearing, Mr.Sree Ranga Rao, learned Counsel for the petitioner, has not disputed that the office of the Sector Leader is not borne on any cadre or governed by Statutory Rules or working guidelines.
In my opinion, unless a person has an enforceable legal right and a corresponding public duty on a public authority, a writ of Mandamus does not lie. Therefore, I am not inclined to entertain the dispute raised by the petitioner in exercise of the jurisdiction of this Court under Article 226 of the Constitution of India.
The Writ Petition is, accordingly, dismissed. As a sequel to dismissal of the Writ Petition, WPMP.No.47310 of 2015, filed by the petitioner for interim relief, is disposed of as infructuous.
