HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.20559 of 2013 ORDER:

This writ petition is filed by the petitioner questioning the action of respondents No.1 to 3 in terminating the contract and in stopping the supply of milk and milk products to the petitioner. 2.

The case of the petitioner is that the petitioner appointed as Distributor on 7.4.2012 and that as the respondents Nos.1 to 3 are showing discrimination in supplying the milk products and they are giving special treatment to the 4th respondent by giving the stock to the 4th respondent on lesser price, the petitioner issued a notice to them. Further, the petitioner requested respondents Nos.1 to 3 to give the benefit available to the 4th respondent to all the other distributors. On that, the respondents Nos. 1 to 3 stopped the supply of the material. Hence, the present writ petition has been filed.

Heard and perused the material available on record. 4.

The main grievance of the petitioner is that the respondents are not providing the material at the rates available to the 4th respondent. 5.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits of the case, this Court is inclined to pass the following order: "The petitioner is directed to make a representation before respondents Nos.1 to 3 for supply of the material or milk products. On such representation being made, the respondents Nos.1 to 3 are directed to consider the case of the petitioner, if the petitioner is eligible for such benefits."
