HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36538 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the order dated 14.09.2017 in Roc.C/559/2013, passed by the Tahsildar, Nagiri mandal, Chittoor District, State of Andhra Pradesh, as illegal and arbitrary.

3) At the time when the matter is taken up for hearing, learned counsel for the petitioner submitted that aggrieved by the orders passed by the Tahsildar - respondent No.3, an appeal came to be filed before the Revenue Divisional Officer - respondent No.2 on 25.09.2017, but till date, no orders are passed in the said appeal.

4) Learned Government Pleader for revenue would submit that a direction may be given to the Revenue Divisional Officer to pass appropriate orders in the appeal filed, at the earliest. It is further stated that since there are no entries, question of transferring the said property would not arise. 5) Be that as it may, having regard to the facts and circumstances of the case, the Revenue Divisional Officer, Chittoor is directed to dispose of appeal No.5017 of 2017,

filed before him by the petitioner, within a period of four weeks from the date of receipt of a copy of the order, in accordance with law, after hearing all the concerned. 6) With the above direction, the writ petition is disposed of.
