THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39940 of 2016 ORDER:
This writ petition is filed by petitioners under Article 226 of the Constitution of India seeking to issue a writ, order or direction more particularly one in the nature of writ of certiorari and to call for the records relating to Crime No.19 of 2016 of Manopad Police Station, Mahaboobnagar District for the offence under Sections 427, 448, 436 and 143 read with Section 149 I.P.C. and after declaring the initiation of the proceedings against the petitioners as illegal and arbitrary, consequently, quash the proceedings against petitioners in the said crime. Heard the learned counsel for petitioners and the learned Assistant Government Pleader for Home and perused the material available on record. The present case is registered against petitioners, since petitioners lodged a complaint against the respondent No.6's family for killing the 1st petitioner's father and further the present offence is subsequent to the death of 1st petitioner's father, who was alleged to have brutally killed by respondent No.6's family.
Considering the said facts and circumstances, respondent No.5 is directed to conclude the investigation without arresting petitioners and file final report, if any, in accordance with law.
Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
