THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.19452 OF 2015 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the respondents in opening the rowdy sheet No.5 of 2009 against the petitioner in the fourth respondent police station and continuing the same as illegal and arbitrary, and consequently to direct the respondents to close the rowdy sheet opened against the petitioner.

Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner was falsely implicated in criminal cases due to political rivalry and that he has been acquitted in all the cases. He further submits that no cases are pending against the petitioner from 2009 and that the petitioner made representations dated 23.08.2014 and 09.04.2015 for closure of the rowdy sheet, but the third respondent has not closed the rowdy sheet pending against the petitioner. Hence, he prays this Court to direct the respondents 3 and 4 to close the rowdy sheet pending against the petitioner.

Considering the facts and circumstances of the case, the petitioner is directed to make a fresh representation to the respondents 3 and 4 stating all the reasons for closure of the rowdy sheet and on filing of such application, the respondents 3 and 4 are directed to consider the representation and pass appropriate orders as expeditiously as possible, preferably within a period of one month from the date of application of the petitioner. It is made clear that if there is any failure on the part of the respondents 3 and 4 to consider the application of the petitioner within a period of one month from the date of the application, the fourth respondent is directed not to compel the petitioner to come to the Police Station without therebeing any case registered against the petitioner.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 02.01.2017 pln
