THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.14259 of 2015 ORDER:

This petition is filed by the petitioner - Accused No.10 under Sections 438 of Criminal Procedure Code seeking to grant bail in Crime No.81 of 2015 on the file of Gangavaram Police Station, Chittoor District, for the offences punishable under Sections 307, 353, 109, 120-B IPC and 29 and 32 of Forest Act r/w. Rule 3 of SW & RSW Transit Rules and 29 of Wildlife (Protection) Act, 55 (2) and 58 of Biological Diversity Act and 3 & 5 of Prevention of damages to Public Property Act and 24(A), 24(B) and 27 of Arms Act. Heard and perused the material available on record. The allegation against the petitioner is that he, along with other accused, was involved in illegal transportation of red sandalwood logs.

Learned Public Prosecutor objected for grant of bail to the petitioner since the petitioner was involved in several other cases, which are similar to the present case.

In view of the above, this Court is not inclined to grant anticipatory bail to the petitioner.
