THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No.1871 OF 2016 ORDER:

The petitioners, who are A-1 to A-3, filed this Criminal Petition under Section 438 Cr.P.C. seeking release in the event of their arrest in connection with crime, which is likely to be registered against them, in K.P.H.B. Police Station, Kukatpally, Hyderabad for offences punishable under Section 498-A I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961 on a report of one Nadimipalli Deelipa, W/o.N.Veera Venkata Subbaraju Varma.

2. Heard.

3. A reading of the averments in the petition would show that there are some disputes between A-1 and his wife due to which there is every likelihood of her lodging a report against the petitioners under Section 498-A I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act.

4. Having regard to the circumstances stated above, in case any report is lodged against the petitioners by the wife of A-1 for the offences which are punishable with imprisonment up to seven years or less than seven years, the Investigating Agency shall comply with Section 41 Cr.P.C. and follow the judgment of the Supreme Court in Arnesh Kumar v. State of Bihar and another[1] before proceeding further.
