HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.43212 OF 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the inaction of the 4th respondent in disposing of the appeal petition filed by the petitioner on 30.10.2016 against the action of the 3rd respondent in not furnishing the information sought for by the petitioner inspite of the orders of the 2nd respondent dated 23.01.2016, as illegal and arbitrary.
Heard the learned counsel for the petitioner and the learned Additional Government Pleader for Revenue for respondents. With their consent, the Writ Petition is disposed of at the stage of admission itself.
The limited grievance of the petitioner in this writ petition is that though he filed an appeal on 30.10.2016 before the 4th respondent, till date no orders are passed therein. Learned AGP would submit that a suitable direction may be given to the 4th respondent to dispose of the appeal filed by the petitioner in accordance with law.
Having regard to the rival submissions made, the Writ Petition is disposed of directing the 4th respondent i.e. The I Appellate Authority under RTI Act-cum-The District Revenue Officer, Kurnool District, to dispose of the appeal petition filed by the petitioner on 30.10.2016 questioning the inaction of the 3rd respondent in furnishing the information sought by the
petitioner, in accordance with law, as early as possible preferably within a period of three months from the date of receipt of a copy of this order.
