HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.14048 of 2015 ORDER:

This writ petition is filed seeking writ of Mandamus declaring the action of the 2nd respondent in not depositing the EPF amounts deducted from the pay bills of the petitioner to his account with the 1st respondent, as illegal and arbitrary.

2. Heard the learned counsel appearing for the petitioner, the learned standing counsel for 1st respondent and Sri P. Kesava Rao, learned standing counsel for the 2nd respondent.

3. It is the case of the petitioner that he is working as Contract Labour with the 2nd respondent through the 3rd respondent and the 2nd respondent has been deducting an amount of 12% of pay towards contribution to the Employees Provident Fund (EPF) along with others. The 2nd respondent has deposited the same till 01.04.2013 and thereafter, though the amounts were deducted from the pay bills, they have not been deposited to the EPF accounts. The petitioner and others made a representation dated 10.09.2014 to the 2nd respondent but so far no action has been taken.

Having regard to the facts and circumstances of the case, the 2nd respondent is directed to examine the representation submitted by the petitioner and others and if the EPF amounts were deducted from the pay bills of the petitioner and have not been credited in the respective accounts for the period mentioned in the representation, the 2nd respondent is directed to take steps to deposit the EPF amounts deducted from the pay bills of the petitioner forthwith.

5. The writ petition is accordingly disposed of at the stage of admission. Miscellaneous petitions, if any, in this writ petition shall stand closed. No order as to

costs.
