M/S. Sri Krishna Electrical Works, v. The A.P. Central Power Distribution Company Ltd.,

THE HON'BLE SRI JUSTICE S.V.BHATT W.P.No.16747 of 2013 ORDER:

Petitioner prays for Mandamus declaring the action of respondent Nos.2 and 3 in not permitting him to engage his own sub-station operators and pressurizing him to engage sub-station operators of the choice of the respondents as illegal, contrary to the terms of the contract and arbitrary.

On 17-06-2013, the following interim order was issued :- " There shall be a direction to the respondent authorities not to interfere with the engaging of sub-station operators by the petitioner except in accordance with the terms and conditions of the agreement dated 07-03-2013."

The 2nd respondent filed counter affidavit and on persons appointed by petitioner and the period of contract, it is stated thus :- " It is submitted that the petitioner has appointed Sri M.Jagadish Kumar, Sri B.Anil Kumar, Sri M.Nagaiah and Sri Jagadish as his contract workers. The respondents have not recommended any person or coerced the petitioner to appoint the persons of their choice. The petitioner has made false allegations only to appoint unqualified persons.

It is submitted that the contract period of the petitioner has been completed and the petitioner is not operating the sub station as on today."

The above statement is placed on record.

The writ petition is disposed of accordingly, as no further order is necessary.

Miscellaneous petitions, if any, pending shall stand closed. No order as to costs.
