THE HONOURABLE SRI JUSTICE RAJA ELANGO Crl.R.C.M.P.No.4108 of 2015 & CRIMINAL REVISION CASE No.3066 of 2015 ORDER:
1. The above Crl.M.P. is filed seeking to condone the delay of 235 days in filing the revision case against the order dated 5.12.2014 passed by the XXIV Metropolitan Magistrate, Cyberabad, Kukatpally, Miyapur.
2. The 2nd respondent, who is the wife of the petitioner, filed DVC No.31 of 2014 before the learned Magistrate. Along with the DVC, she filed Crl.M.P.No.55 of 2014 seeking to grant interim maintenance of Rs.10,000/- per month. The trial Court allowed the said Crl.M.P. granting maintenance of Rs.10,000/- per month towards interim monthly monetary relief to the 2nd respondent and her daughter. Aggrieved by the same, the petitioner filed this revision along with above Crl.R.C.M.P seeking to condone the delay in filing the revision.
3. Heard and perused the material available on record.
4. The reasons assigned by the petitioner in the affidavit filed in support of the petition, are not convincing. Therefore, this Court is not inclined to condone the delay in filing the revision.
5. Accordingly, the above Crl.R.C.M.P. is dismissed and consequently, Crl.R.C. (sr) is dismissed. However, in view of the fact that DVC case is pending against the petitioner and taking into consideration the litigation between the parties, the petitioner is directed to pay maintenance at the rate of Rs.5,000/- p.m., instead of Rs.10,000/- per month, to the 2nd respondent and her daughter on or
before 15th of every succeeding month. The arrears shall be paid within a period of three months at the rate fixed by this Court. The trial Court is directed to dispose of the DVC as expeditiously as possible, preferably within a period of three months, without being influenced by the above order.
