ORDER
The petitioner, who is A.1 in crime No.123 of 2016 of East Police Station, Tirupati, Chittoor District, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with above crime registered for an offence punishable under Sections 420, 466, 468 and 471 read with 34 of Indian Penal Code. Heard learned counsel for the petitioner as well as the learned Public Prosecutor appearing for the respondent-State. The case of the prosecution is that the petitioner is alleged to have created fake documents promising to provide employment in Tirumala Tirupathi Devastanam and also created fake appointment letters, which he handed over to A.2 enabling the un-employees to get money. It is true that the case is based on confession of A.2, but as seen from the record, the matter requires investigation as the offences alleged against A.1 are grave and serious in nature.
In view of the same, the Criminal Petition is dismissed. However, the petitioner, if so advised, shall appear before the trial Court and move an application for grant of bail after giving prior notice to the Public Prosecutor, in which event the same shall be dealt with by taking into consideration the circumstances referred to above in accordance with law, at the earliest.
