HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40248 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the respondents 2 to 5 in interfering with the civil disputes and calling the petitioner to the police station, as illegal and arbitrary and consequently, direct the respondents 2 to 5 not to interfere with the possession and enjoyment of the petitioner over an extent of Acs.1.42 cents of land in Sy.No.165/ 2, No.32, Konkachennayagunta Village, Tirupathi Urban.

Heard and perused the material available on record. The grievance of the petitioner is that she entered into an agreement of sale with one K. Venkata Reddy to purchase the above said property and though she is ready to get the property registered, said Venkat Reddy, without registering the property in favour of the petitioner, tried to sell the same to a third party, and therefore, she filed a civil suit, and obtained decree. The respondents 6 to 9, who are purchasers of Venkat Reddy, approached the police and instigating to take action against the petitioner.

Learned Assistant Government Pleader for Home submitted that the respondent police are not intending to interfere with the civil disputes.

Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

" The respondents 2 to 5 are directed not to interfere with the affairs of the petitioners and the respondent 6 to

9, more particularly, with the civil disputes pending between them. However, this Order will not stand in the way of the respondents 2 to 5 to register a case, if any complaint is lodged against the petitioner for cognizable offence."

There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ______________ RAJA ELANGO, J November 22, 2016 KTL
