Subhash Reddy) This Civil Miscellaneous Appeal is filed by defendants 2 and 5 in O.S.No.20 of 2014 on the file of the Special Sessions Judge for Trial of Cases under S.Cs. & S.Ts.

(PoA) Act-cum-Additional District Judge, Khammam, aggrieved by the order and decree dated 21.10.2014 passed in I.A.No.378 of 2014. 2. The 1st respondent herein filed the aforesaid suit for partition and separate possession of 1/5th share in the suit schedule properties. Alleging that the defendants in the suit are trying to alienate the properties to defeat her claim, she filed I.A.No.378 of 2014 under Order 39 Rules 1 and 2 CPC for grant of interim injunction restraining the respondents-defendants from alienating, transferring, mortgaging or introducing third party rights with regard to petition schedule properties during pendency of the suit. The court below, having considered the oral and documentary evidence on record and the pleadings, has allowed the I.A., by order dated 21.10.2014 granting injunction as prayed for. 3.

Heard the learned counsel for the appellants and the learned counsel for the respondents. 4. It is submitted by the learned counsel for the appellants that in the absence any evidence to show that the suit schedule properties are ancestral properties and the 1st respondentplaintiff is having 1/5th share, on mere asking, the trial court has granted injunction. It is further submitted that the suit schedule properties are purchased by the own earnings of the 1st appellant and the court below wrongly relied on the statement of the 1st respondentplaintiff, that the properties are ancestral properties left behind by their father Nalli Christopher, in the absence of any documentary evidence. 5.

On the other hand, it is submitted by the learned counsel for the 1st respondent-plaintiff that no evidence is placed on record by the appellants to show that the suit schedule properties are acquired by them out of their earnings. It is further submitted that as all the suit schedule properties are ancestral properties left behind by their father father Nalli Christopher, the 1st respondent-plaintiff is entitled for ​1/5th share. 6. It is the specific case of the 1st respondent-plaintiff that all the suit schedule properties are urban properties situated in Khammam and they are acquired by their father Nalli Christopher. Although it is the case of the 1st appellant that the properties on his name are acquired out of his own earnings, he has not produced any evidence.

It is not in dispute that Nalli Christopher left behind his wife and four children. ​The 1st respondent-plaintiff and one of his sons Nalli Vinod Kumar are sailing together and claiming rights in respect of the suit schedule properties and another daughter Nalli Parimala remained ex parte. When the 1st appellant claims that suit schedule properties are acquired out of his own earnings, it is for him to prove the same. Except one will deed, no other document is filed on behalf of the appellants-defendants. Whether the suit schedule properties are acquired by Nalli Christopher in the name of his son Nalli Anil Kumar, i.e. the 1st appellant herein, or Nalli Anil Kumar has purchased the same out of his own earnings, are matters which are to be considered after full-fledged trial.

In view of the specific stand of the 1st respondent-plaintiff that the suit schedule properties are properties which are left behind by their father Nalli Christopher, and, further, one of the sons of Nalli Christoper, i.e. Nalli Vinod Kumar is consenting for partition and also in view of the documentary evidence on record, we are of the view that it is a fit case to continue the injunction as ordered by the court below pending disposal of the suit; otherwise it leads to multiplicity of proceedings. 7. Having regard to the findings recorded by the court below, we find no merit in this Civil Miscellaneous Appeal so as to interfere with the impugned order granting interim injunction, restraining alienation of the suit schedule properties pending disposal of the suit filed by the 1st respondentplaintiff. 8.

The Civil Miscellaneous Appeal is accordingly dismissed. No order as to costs. As a sequel, miscellaneous petitions if any pending in the appeal stand closed. _____________________ R.
