Heard.

The petitioner seeks survey of his 1/3rd share in house with D.No.6/39 of Vajrakarur Village and Mandal of Anantapuram District. The present Writ Petition is filed alleging that the 2nd respondent is not deputing the 4th respondent to conduct survey of the building in question.

The instructions of learned Government Pleader for Revenue show that the petitioner has neither applied, nor remitted the requisite fee in Mee-Seva and unless the petitioner makes appropriate application to depute the Mandal Surveyor to conduct survey of the building, no action can be taken thereon. It is also stated that the father of the petitioner was the original owner, who is succeeded by three sons and each having 1/3rd share. It is further stated that the petitioner is the third son and his second brother is stated to have occupied 2/3rd share and there is a financial dispute between himself and the second brother. Evidently, the petitioner has not made any application and unless he applies as per the requirement of the rules by paying necessary fee, no further action could be taken by the 2nd respondent.

Hence, no relief can be granted to the petitioner, except giving liberty to him to make appropriate application in accordance with law and if such an application is made, the 2nd respondent shall examine the same and take appropriate steps. The Writ Petition is, accordingly, disposed of. There shall be no order as to

costs.
