HON'BLE SRI JUSTICE S.V. BHATT W.P.No.1967 OF 2013 ORDER:

The writ prayer reads as follows:

"..to issue a writ, order or direction more in the nature of writ of Mandamus declaring the action of the respondents 6 and 7 in not including the names of the petitioners in the Final Voters list in spite of the order in PIL MP No.5/2013 in PIL No.4/2013, dated 9-01-2013 as illegal, arbitrary and violative of Art. 14 of the Constitution of India and consequentially to direct the respondent No.7 to include the names of the petitioners herein in die final Voters list of 6th respondent Society.."

The cause of action for filing the writ petition is that for the elections scheduled to be held by 6th respondent, though the petitioners claim to be fully compliant to become members of the Society, they are not registered as members and included in the voters list. Counsel for the petitioners submits that the elections are over but the counsel does not have instructions on the latest position vis-à-vis the request of petitioners to become members of the Society.

Since the grievance is with reference to the elections scheduled in January-February, 2013, I am not proposing to consider the grievance of the petitioners at this stage of the matter. The petitioners by enclosing all the evidence in support of their assertion for becoming either members of the 6th respondent Society and also inclusion of their names in voters list are given liberty to represent to respondents/ competent authority,

including the grievance canvassed in this writ petition and if such representation is made, the respondents/ competent authority are directed to consider and pass orders within eight weeks from such representation.

The writ petition is, accordingly, disposed of. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, stand closed.
