This writ petition is filed challenging the proceedings in Roc.No.E2-418-2016, dated 25-11-2016, wherein the 3rd respondent directed the 4th respondent to dispose of the seized stocks from the petitioner pending enquiry under Section 6-A of the Essential Commodities Act (for short "the Act").

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Civil Supplies. Learned counsel for the petitioner disputes that the seized stock is the PDS rice and seeks for release of the same pending enquiry under Section 6-A of the Act. Learned Assistant Government Pleader for Civil Supplies opposes the same and states that PDS rice cannot be released pending enquiry and further states that the issue can be decided only after enquiry under Section 6-A of the Act.

In view of above facts and circumstances of the case, the Joint Collector, Chittoor is directed to dispose of the enquiry under Section 6-A of the Act within a period of four weeks from the date of receipt of a copy of this

order. There shall be stay of sale of seized stocks pending enquiry under Section 6-A of the Act.

With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
