THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.11363 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking following relief:

"to issue writ of Mandamus declaring the action of the respondents 2 and 3 in not considering the petitioner's representation, dated 25-03-2015, for grant of licence under Tree for Tapper Scheme, in favour of the petitioner for the present excise year 2015-16, for a period of 5 years, from the date of issuance of licence, in respect of Toddy Shop, Chandapur Village, Tadvoi mandal, Nizamabad District, as illegal, arbitrary and violation of principles of natural justice and consequently direct the respondents to grant the licence in favour of the petitioner, under Tree for Tapper Scheme, for the present excise year 2015-16, for a period of 5 years, from the date of issuance of licence, in respect of Toddy Shop, Chandapur Village, Tadvoi Mandal, Nizamabad District."

Heard Sri B. Sai Ram Goud, learned counsel for the petitioner and learned Government Pleader for Prohibition and Excise, Telangana. According to the petitioner, he is a poor tapper and eking out his livelihood by selling toddy to the consumers. It is also stated in the writ affidavit there is an existing tree for tapper scheme in Chandapur village, Tadvoi mandal, Nizamabad District. It is also stated that the petitioner herein made a representation to respondent Nos.2 and 3 on 25-03-2015, requesting to issue licence under Tree for Tapper Scheme in respect of toddy shop, Chandapur village, Tadvoi Mandal, Nizamabad District, for the present excise year.

The only complaint in the present writ petition is that no orders have been passed on the said representation submitted by the petitioner herein. In these circumstances, the writ petition is disposed of directing the

respondents 2 and 3 herein to pass appropriate orders on the representation, dated 25-03-2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of one month from the date of receipt of a copy of this order. There shall be no order as to costs. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
