THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.41419 of 2015 ORDER:
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue a Writ order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not allowing the petitioner to run the Counter No.4, TFT Maddigatla, Bhootpur Mandal, Prohibition & Excise Station, Jadcherla, Mahabubnagar District, Telangana State in view of the validity of the License bearing No.41/2011, which is valid upto 3009-2017 as arbitrary, illegal and against the principles of natural justice and to pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case." The Prohibition and Excise Superintendent, Mahabubnagar, furnished written instructions dated 23.12.
2015 to the office of the learned Government Pleader for Excise, wherein he stated that the petitioner's licence was cancelled vide proceedings bearing Rc.No.B2/786/2014 dated 17.01.2015. In the light of the afore-stated development, Sri D.L. Pandu, learned counsel for the petitioner, fairly states that liberty may be given to the petitioner to pursue his remedies against the cancellation of the licence in accordance with law. The writ petition is accordingly dismissed with the liberty afore-stated. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
