THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36834 of 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of Certiorari declaring the F.I.R.No.583 of 2016 on the file of the third respondent against the petitioner as illegal and arbitrary and consequently, to quash the same. Heard and perused the material.
Learned counsel for the petitioner submits that the petitioner is a student and that the fourth respondent, who lodged the complaint, is also a student and that the group of students attended an event at Hitech Exhibition Grounds, Madhapur, held on 08.10.2016. He submits that the dispute arose between A.1 and the fourth respondent and in this connection, the fourth respondent lodged the complaint including the other students. He further submits that the petitioner has not committed any offence and that the complaint is lodged on 09.10.2016 at 6.30 p.m., for the alleged occurrence took place on 08.10.2016 and as such, there is a delay of one day. Hence, he prays this Court to quash the F.I.R.
Considering the facts and circumstances of the case, this Court is not inclined to quash the proceedings at the threshold. However, taking into consideration the age of the petitioner and also as the dispute arises among the students, the third respondent is directed to complete the investigation without arresting the petitioner and file final report, if any, in accordance with law.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 31.10.2016 pln
