HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36621 of 2018 ORDER:

1) Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in threatening to dispossess the petitioner from the land admeasuring Ac.1.17 guntas in Survey No.442/E/1 and total extent of land admeasuring Acs.2.28 guntas, situated at Indurthi village, Marriguda mandal, Nalgonda district, Telangana State, as illegal and arbitrary. 3) Learned Government Pleader for revenue placed before the Court the instructions received from the Tahsildar, which reads as under:

"In reply to para No.4 of the affidavit, I humbly submit as per the sub division record an extent of Acs.16.15 guntas and Acs.13.05 guntas in total of Ac.29.20 guntas of land consisting in Survey Nos.441 and 442 respectively, in which the Government was acquired an extent of Acs.13.04 guntas and Acs.11.28 guntas in total of Acs.24.32 guntas respectively in above survey numbers the construction agency was taken up the work of Shivannagudem Balancing only in acquired lands. It is further submitted that the

official respondents have not interfered with the possession and enjoyment of the petitioner's land and their notified structures mentioned in with reference to the above 2nd cited."

4) Recording the same, the writ petition is closed making it clear that any interference by the authorities shall only be in accordance with the due procedure established by law. 5) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
