THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.14041 OF 2015 ORDER:

This criminal Petition is filed by the petitioner - Accused No.4 under Section 438 Cr.P.C., seeking to grant anticipatory bail in PRC No.50 of 2013 on the file of Additional Magistrate of First Class, Kovur, Nellore District, arising out of Crime No.175 of 2012 of Buchireddypalem Police Station, Nellore District, registered for the offences punishable under Sections 498-A and 306 IPC and Sections 3 & 4 of the Dowry Prohibition Act.

Heard and perused the material available on record. The petitioner is the sister-in-law of the deceased. The allegation against the petitioner is that due to the harassment made by the petitioner and the other accused demanding additional dowry, the deceased committed suicide.

The learned counsel for the petitioner submitted before this Court that since the petitioner is in USA, she could not attend the Court and hence, the Court below issued NBWs against her and the petitioner is ready to face the trial and she will not flee from the hands of justice.

Having heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and having perused the material available on record, this Court is of the view that the revision can be disposed of with the following directions:

The petitioner is directed to appear before the Court concerned and file a petition to recall the warrant issued against him and on such filing of a petition, the trial Court is directed to recall the warrant on the same day on his execution of bond for a sum of Rs.10,000/- (Rupees ten thousand only) with one surety for a like sum and further the petitioner is directed to appear before the trial Court regularly. Accordingly, the Criminal Petition is disposed of. ______________ RAJA ELANGO, J January 05, 2016.
