SMT. JUSTICE T. RAJANI CRIMINAL PETITION No.8258 OF 2011 ORDER:
This criminal petition is filed under Section 482 Cr.P.C., to quash the proceedings in C.C.No.659 of 2009 on the file of the IV Additional Judicial Magistrate of First Class, Chittoor, against the petitioner/A.11.
Learned counsel for the petitioner and the learned Public Prosecutor submit that charge sheet is filed in the above said case. Hence, petitioner has an effective remedy before the trial Court. They can file discharge petition and raise all the grounds in the said petition.
The criminal petition is accordingly disposed of. However, considering the request of the learned counsel for the petitioner, the trial Court is directed not to insist upon the presence of the petitioner unless otherwise required.
As a sequel, miscellaneous petitions if any pending stand closed.
