HON'BLE SRI JUSTICE A. SHANKAR NARAYANA C.R.P.No.3130 OF 2015 ORDER:
The present revision petition, under Article 227 of the Constitution of India, is filed aggrieved over the order, dated 29.06.2015, passed in Tr.O.P.No.13 of 2014 by the learned District Judge, Prakasam at Ongole.
2. Tr.O.P.No.13 of 2014 is filed by the petitioners seeking to transfer O.S.No.192 of 2012 from the file of learned III Additional Junior Civil Judge, Ongole, to the file of learned Additional Senior Civil Judge, Ongole, to try with O.S.No.412 of 2012. By the impugned order, dated 29.06.2015, the learned District Judge dismissed the Tr.O.P.
3. When the matter is called, though, the learned counsel for petitioners requested for an adjournment, but, the case status report placed by the Registry would show that the suit in O.S.No.192 of 2012 was dismissed for default on 06.09.2017.
4. In such an event, the present revision petition becomes infructuous.
5. Hence, the present revision petition is dismissed as infructuous, however, with liberty to the petitioners to revive the request, in case, the said O.S. is restored to file.
Miscellaneous Petitions, if any, pending in this revision petition shall stand closed. There shall be no order as to costs. ___________________________ A. SHANKAR NARAYANA, J April 27, 2018.
