THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2369 of 2016 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioners/A-1 to A-3 in C.C.No.413 of 2013 pending on the file of Judicial First Class Magistrate at Suryapet, Nalgonda for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of Dowry Prohibition Act.
Heard the learned counsel for the petitioners/A-1 to A-3 and the learned Public Prosecutor and perused the material available on record.
Admittedly, a case was registered against the petitioners basing on the complaint given by the 2nd respondent/de facto complainant for the alleged offences, wherein specific allegations are made against the petitioners/A-1 to A-3, the truth or otherwise of which will be determined after a full-fledged trial, but the same cannot be ascertained at the initial stage.
Having regard to the facts and circumstances of the case and also in view of the nature of offences alleged against the petitioners, this Court is not inclined to quash the proceedings against the petitioners/A-1 to A-3. However, at this stage, the learned counsel for the petitioners stated that the petitioners/A-1 to A-3 are facing very much difficult in attending the court on each and every date of adjournment and that at least their presence before the Court may be dispensed with.
Considering the request of the learned counsel for the petitioners, the presence of the petitioners 2 and 3/A-2 and A-3
before the Court is dispensed with except on the dates when their presence is essentially required by the Court. The 1st petitioner/A1 shall present before the Court on each and every date of adjournment on his behalf and also on behalf of petitioners 2 and 3/A-2 and A-3.
With the above direction, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
