THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.35057 of 2015 ORDER:

Petitioner states that the Government of Andhra Pradesh allotted land to an extent of Acs.41.35 cents in Survey No.640/1 of Nallapadu Village, Guntur Rural in its favour after receiving the land value. Possession is also said to have been delivered to it. It however made a request for survey of the said land by submitting an application on 05.03.2015 and also paid the fee through A.P. Online under receipt of the same date. Alleging inaction on the part of the respondents in conducting survey, the present Writ Petition is filed.

It is stated by the learned Assistant Government Pleader that on the request of the petitioner, the Mandal Surveyor has examined the land and he submitted a report stating that the land is covered with shrub growth and bushes and looks like jungle with Tumma Trees. Hence, without clearing the same, survey and demarcation cannot be done. Hence, the petitioner is stated to have been informed the same orally.

It is not possible to accept the contention of the respondents that orally, the petitioner is informed. Since the petitioner has submitted application through Mee Seva by paying requisite fee for survey of the land in question, the third respondent has to consider such application and pass appropriate written orders thereon. Hence, the Writ Petition is disposed of directing the third respondent to act accordingly and communicate the orders to the petitioner, expeditiously. Miscellaneous Petitions, if any pending in this Writ Petition shall stand closed. No order as to costs.
